Firefighting Foam (AFFF) And Other PFAS Forever Chemical Lawsuits May Be Larger Than Tobacco Lawsuits

Firefighting foam runoff and other PFAS forever chemical waste may have permanently contaminated local waterways

Thursday, August 10, 2023 - The number of AFFF lawsuits and other forever chemical lawsuits may soon make PFAS forever chemical litigation the largest mass tort in history according to an article published recently in Time. "Currently, there are more than 15,000 claims that have been filed nationwide against DuPont--and its spinoffs Chemours and Corteva--along with 3M, the major manufacturers of PFAS in the U.S. So far, DuPont, Chemours, Corteva, and 3M have paid a total of nearly $11.5 billion in damages for PFAS contamination. But that number could grow considerably, even exceeding the more than $200 billion paid by Big Tobacco in the 1990s. And well it should, environmental lawyers argue." There are hundreds of chemical manufacturing plants producing PFAS forever chemical waste located throughout the United States. And many of them are located on rivers where farmers rely on the water supply to irrigate their crops or water their livestock. More than 1000 military bases and airports also use firefighting foam to extinguish petroleum and jet fuel fires and wash the waste down into the soil and water table. The proximity of chemical manufacturing facilities, military bases, and airports to local populations, combined with the potential discharge of PFAS contaminants into local streams, lakes, and rivers introduces an element of risk to millions of people that live and work in the communities. Both human health and environmental welfare may have been irreparably damaged by the recklessness, carelessness, and negligence of PFAS forever chemical manufacturers dumping their waste into the local waterways.

Thousands of AF firefighting foam lawsuits are expected to be filed this year and next. More than one dozen US state Attorney Generals have already filed lawsuits against forever chemical manufacturers seeking billions of dollars in restitution to remediate the local environment. South Carolina is the latest US state to file a lawsuit against 3M, DuPont, and other manufacturers of toxic AF firefighting foam. Their lawsuit joins Alaska, California, Colorado, Delaware, Florida, Illinois, Massachusetts, Michigan, Minnesota, New Hampshire, New Jersey, New York, North Carolina, Ohio, Vermont, and Wisconsin who have also filed. It is doubtful, however, that cleaning PFAS forever chemicals could be accomplished since the contaminates already permeate the water, air, and soil. Even the rainwater is hopelessly contaminated with PFAS forever chemicals according to experts. An article recently published in USA Today titled: " Rainwater is now unsafe to drink worldwide because of 'forever chemicals,' study suggests" paints a grim picture. " A host of possible serious health consequences has been associated with PFAS, including cancer, infertility and pregnancy complications, immune system problems and increased cholesterol, according to researchers at Stockholm University and ETH Zurich." PFAS Forever chemical lawsuits seek to hold the makers of forever chemicals financially responsible for their negligence. If you or a loved one has developed cancer, or are the survivors of someone who has died from the disease, and live near a military base, airport, or chemical manufacturing plant, you may be eligible to file a claim.
